SX Consent SMS Terms

These SMS Terms (“SMS Terms”) apply to SMS, MMS, text message, mobile message, one-time passcode, verification code, transactional notice, operational notice, account notice, privacy notice, security notice, app-readiness notice, session-readiness notice, closure reminder and related mobile messaging programs operated by or on behalf of SX Consent Application (“SX Consent,” “we,” “us,” or “our”).

SX Consent is operated by Beniquez Sanchez and Company LLC and was created by BS and Co AI Labs.

By providing your mobile number in a clearly disclosed SMS opt-in workflow, checking an SMS consent box, requesting a verification code, entering a one-time passcode, enabling SMS notices, using phone verification, replying to an SX Consent message, or otherwise expressly consenting to receive text messages from SX Consent, you agree to these SMS Terms.

Creating an SX Consent account or accepting general Terms and Conditions does not, by itself, opt you into optional SMS messaging. Some security, verification, account-readiness, privacy, session-readiness or operational features may require SMS or phone verification where technically, legally or operationally necessary.

If you do not agree to these SMS Terms, do not opt in to SMS messaging and do not use SX Consent features that require SMS verification or SMS-based operational notices.

  1. Relationship to Other SX Consent Policies

These SMS Terms supplement and are incorporated into:

  • Terms and Conditions;
  • Privacy Policy;
  • Sensitive Data Consent;
  • Health Data Handling Policy;
  • Payment, Cancellation and Refund Policy;
  • Account Deletion Policy;
  • Data Deletion Policy;
  • any in-app SMS opt-in disclosure;
  • any phone verification disclosure;
  • any notification-readiness disclosure;
  • any provider-specific disclosure;
  • any App Store, Google Play, Twilio, carrier or payment-provider requirement.

If there is a conflict between these SMS Terms and another SX Consent policy, the document most specific to the SMS, phone verification, mobile messaging or communications issue will control, unless applicable law or a controlling provider requirement requires otherwise.

  1. SMS Program Name

The SX Consent SMS messaging program may be identified as:

SX Consent Operational Notices

or another similar SX Consent operational messaging program name.

Messages may be sent from a 10DLC number, short code, toll-free number, alphanumeric sender ID where permitted, verified sender, messaging service, carrier-approved number or other sender authorized for SX Consent messaging.

  1. Nature of SX Consent SMS Messages

SX Consent SMS messages are intended to be transactional, operational, verification-related, account-related, security-related, privacy-related, app-readiness-related, session-readiness-related, closure-related or support-related.

SX Consent SMS messages are not intended to be adult content messages, dating messages, hookup messages, explicit-content messages, public social networking messages, medical advice, legal advice, emergency dispatch, or marketing messages unless a separate compliant marketing opt-in is obtained.

SX Consent may send SMS messages related to:

  • phone number verification;
  • one-time passcodes;
  • account creation;
  • login or authentication;
  • account security;
  • suspicious account activity;
  • device verification;
  • identity-readiness status;
  • app-readiness requirements;
  • SMS opt-in confirmation;
  • SMS opt-out confirmation;
  • privacy request status;
  • account deletion request status;
  • data deletion request status;
  • session-readiness notices;
  • notification-readiness notices;
  • location-readiness notices;
  • session status changes;
  • closure reminders;
  • support responses;
  • billing or subscription account notices;
  • legally required notices;
  • provider compliance notices;
  • important updates about SX Consent account access or service functionality.
  1. No Sensitive Details in SMS Content

SX Consent attempts to avoid including sensitive private-session details in SMS messages.

SMS messages should not include detailed information about:

  • intimate session terms;
  • private boundary matrix selections;
  • STD/STI status;
  • health declarations;
  • health document contents;
  • safety words;
  • safe phrases;
  • duress phrases;
  • private notes;
  • explicit sexual context;
  • evidence package contents;
  • detailed agreement clauses;
  • another user’s private information;
  • sensitive legal or health details.

Instead, SX Consent SMS messages will generally direct users to open the SX Consent app or website to review sensitive details securely.

Examples of safer SMS wording may include:

  • “SX Consent verification code: 123456. Do not share this code.”
  • “SX Consent: Your account requires a security action. Open the app to continue.”
  • “SX Consent: A session status changed. Open the app to review.”
  • “SX Consent: You have a pending closure response. Open the app to complete it.”
  • “SX Consent: Location readiness is required before starting your session. Open the app to continue.”
  • “SX Consent: Your privacy request status was updated. Open the app to review.”
  1. Opt-In Consent

You may opt in to SX Consent SMS messaging by one or more of the following methods:

  • entering your mobile number in the SX Consent app or website;
  • checking an SMS consent checkbox;
  • requesting a phone verification code;
  • completing phone verification;
  • enabling SMS notices in account settings;
  • enabling account security SMS;
  • enabling critical operational SMS;
  • enabling session-readiness SMS;
  • enabling closure reminder SMS;
  • sending an opt-in keyword where supported;
  • re-opting in after a previous opt-out;
  • providing consent through another clearly disclosed SX Consent consent workflow.

Your opt-in must be affirmative, voluntary, specific and associated with the SX Consent messaging program.

You agree that SX Consent may store evidence of your consent, including:

  • mobile phone number;
  • opt-in timestamp;
  • opt-in method;
  • opt-in screen or form version;
  • consent text displayed;
  • IP address;
  • device metadata;
  • user account ID;
  • browser or app version;
  • phone verification status;
  • consent status;
  • source URL or app screen;
  • audit logs;
  • provider records.
  1. Separate SMS Consent

SMS consent is separate from general acceptance of Terms and Conditions, Privacy Policy, Sensitive Data Consent, purchase terms or account creation.

Where required by law or provider policy, SX Consent will present SMS consent separately from other required agreements.

Declining optional SMS consent may allow you to complete certain basic actions, where technically and legally available. However, some SX Consent features may require SMS verification or critical operational notices for security, account integrity, session readiness, privacy workflows or safety-related functionality.

If you decline SMS consent, opt out, or revoke SMS permission, SX Consent may restrict, disable or block features that require SMS-based verification or critical operational messaging.

  1. Phone Verification and OTP Consent

SX Consent may require phone verification before allowing access to certain features.

By requesting or receiving a one-time passcode, verification code or phone verification message, you consent to receive SMS messages needed to verify your phone number.

If you do not consent to receive verification SMS, SX Consent may be unable to verify your mobile number and may restrict account creation, onboarding, identity-readiness workflows, session features, active session workflows, privacy request workflows or other features requiring a verified mobile number.

  1. Message Frequency

Message frequency varies.

The number of SMS messages you receive may depend on:

  • account creation;
  • login attempts;
  • verification attempts;
  • security events;
  • app-readiness status;
  • session activity;
  • notification-readiness status;
  • closure reminders;
  • privacy requests;
  • account deletion requests;
  • data deletion requests;
  • support activity;
  • provider requirements;
  • changes to your settings;
  • regulatory or operational needs.

You may receive multiple messages in a day if multiple account, security, verification, session, closure or privacy events occur.

  1. Message and Data Rates

Message and data rates may apply.

Your mobile carrier may charge for SMS, MMS, data, roaming, international messaging or other mobile services according to your mobile plan.

SX Consent is not responsible for carrier charges, data charges, roaming charges, message fees, device charges or any fees imposed by your mobile provider.

  1. Supported Carriers and Delivery

SMS message delivery is subject to carrier availability, provider availability, network conditions, device compatibility, phone number status, geographic availability, filtering, blocking, routing, outages, regulatory limits, A2P registration status and other factors outside SX Consent’s control.

SX Consent does not guarantee:

  • message delivery;
  • delivery speed;
  • delivery order;
  • delivery to every carrier;
  • delivery in every jurisdiction;
  • uninterrupted messaging;
  • message receipt;
  • message readability;
  • notification appearance;
  • carrier support;
  • prevention of filtering or blocking.

Carriers are not liable for delayed or undelivered messages.

  1. User Responsibility for Mobile Number Accuracy

You are responsible for providing and maintaining an accurate mobile number.

You agree that:

  • the mobile number you provide belongs to you or you are authorized to use it;
  • you will not provide another person’s phone number without authorization;
  • you will promptly update your account if your mobile number changes;
  • you will not use a shared, unauthorized, temporary, fraudulent, stolen or misleading phone number;
  • you will not attempt to verify or use another person’s number;
  • you will not use SMS features to harass, impersonate, defraud or harm anyone.

If you change, surrender, transfer or lose access to your mobile number, you must update your SX Consent account immediately.

  1. Reassigned, Recycled or Transferred Phone Numbers

Mobile numbers may be reassigned, recycled, transferred or reissued by carriers.

If you fail to update your mobile number, SMS messages intended for you may be sent to the new holder of that number.

You agree to notify SX Consent immediately if:

  • your number changes;
  • you no longer control your number;
  • your phone is lost or stolen;
  • your SIM is transferred;
  • your carrier account changes;
  • you suspect unauthorized use.

SX Consent is not responsible for disclosure, loss or harm caused by your failure to update your phone number or secure your mobile device.

  1. Device Security and Notification Privacy

SMS messages may appear on lock screens, notification centers, wearable devices, synced devices, vehicles, computers or other connected systems depending on your device settings.

You are responsible for securing:

  • your phone;
  • SIM card;
  • lock screen;
  • notification previews;
  • device passcode;
  • biometric access;
  • cloud sync;
  • linked devices;
  • carrier account;
  • email account;
  • app access.

SX Consent is not responsible for disclosure caused by your device settings, notification previews, shared devices, compromised devices, carrier issues or unauthorized access to your phone.

  1. Opt-Out Instructions

You may opt out of SX Consent SMS messages by replying:

STOP

Where supported, similar opt-out keywords may also work, such as:

  • STOPALL;
  • UNSUBSCRIBE;
  • CANCEL;
  • END;
  • QUIT.

After you opt out, SX Consent may send one final SMS message confirming that your opt-out request has been processed.

After that confirmation message, SX Consent will not send additional SMS messages to that number unless you re-opt in or where another legally permitted exception applies.

Opting out of SMS may prevent you from using features that require SMS verification, phone verification, security messages, operational notices, session-readiness notices or closure reminders.

  1. Re-Opt-In Instructions

If you previously opted out, you may be able to re-opt in by:

  • replying START where supported;
  • replying UNSTOP where supported;
  • updating SMS preferences in the SX Consent app;
  • requesting a new verification code after re-consenting;
  • completing another SX Consent opt-in workflow.

Re-opt-in may require additional verification.

SX Consent may refuse re-opt-in if the account is suspended, terminated, flagged for abuse, involved in fraud, legally restricted, or otherwise ineligible.

SMS HELP responses may provide basic information, such as support contact details, opt-out instructions or a link to SX Consent resources.

Do not send sensitive private-session details, health information, safety words, duress phrases, legal claims, evidence package contents, identity documents or other sensitive information by SMS.

  1. SMS Opt-Out and Feature Restrictions

SX Consent is designed to support privacy, security, session readiness, account verification and post-session closure.

Some features may require SMS or verified phone functionality.

If you opt out of SMS, SX Consent may:

  • restrict account creation;
  • restrict login;
  • restrict phone verification;
  • restrict identity-readiness workflows;
  • restrict app-readiness status;
  • restrict session invitations;
  • restrict active session start;
  • restrict location-readiness features;
  • restrict closure workflows;
  • restrict account recovery;
  • restrict support workflows;
  • restrict evidence-related workflows;
  • require alternative verification if available;
  • suspend or limit account access.

SX Consent is not liable for loss of access, inability to use features, missed notices, failed readiness, missed closure deadlines or reduced functionality caused by your SMS opt-out.

  1. No Marketing Without Separate Consent

SX Consent SMS messages are intended to be transactional and operational.

SX Consent does not intend to send promotional or marketing SMS messages through the critical notifications program unless we obtain separate consent where required.

If SX Consent later offers marketing SMS, promotional SMS, commercial offers or advertising messages, we will provide a separate opt-in or other legally required consent mechanism.

Consent to receive transactional or operational SMS does not automatically mean consent to receive marketing SMS.

  1. No Sale or Sharing of SMS Opt-In Data for Marketing

SX Consent does not sell, rent, trade, lease, disclose or share SMS opt-in consent, mobile numbers or SMS consent records with third parties or affiliates for their own marketing or promotional purposes.

SX Consent may share SMS-related information with service providers only as necessary to operate messaging, verify consent, send messages, prevent fraud, maintain compliance, troubleshoot delivery, process opt-outs, respond to support, comply with law or protect rights and safety.

  1. SMS Data We May Collect

SX Consent may collect and process SMS-related information, including:

  • mobile phone number;
  • opt-in status;
  • opt-out status;
  • re-opt-in status;
  • phone verification status;
  • one-time passcode request timestamps;
  • SMS delivery events;
  • provider message IDs;
  • carrier metadata;
  • country code;
  • delivery status;
  • failed delivery status;
  • HELP and STOP activity;
  • message templates;
  • message categories;
  • consent screen version;
  • IP address;
  • device metadata;
  • user account ID;
  • audit logs;
  • support records.

SMS data is handled according to the Privacy Policy, Sensitive Data Consent and these SMS Terms.

  1. SMS Data Retention

SX Consent may retain SMS-related records for as long as reasonably necessary to:

  • prove consent;
  • prove opt-out;
  • process re-opt-in;
  • comply with Twilio, carrier, A2P, CTIA, TCPA or legal requirements;
  • prevent fraud;
  • prevent abuse;
  • maintain security;
  • support account verification;
  • respond to disputes;
  • defend chargebacks;
  • preserve audit trails;
  • enforce Terms and Conditions;
  • comply with legal process;
  • protect users and the platform.

SMS consent records may be retained even after account deletion where retention is reasonably necessary for legal, compliance, fraud-prevention, evidence, security or dispute purposes.

  1. SMS and Sensitive Data

SX Consent may use SMS to notify you that an action is required, but SX Consent attempts to avoid sensitive details in SMS content.

You should not send sensitive information by SMS, including:

  • STD/STI information;
  • health documents;
  • identity documents;
  • private boundary selections;
  • intimate session details;
  • safety words;
  • safe phrases;
  • duress phrases;
  • private notes;
  • evidence package contents;
  • legal claims;
  • another user’s private information.

If you send sensitive information by SMS, you do so at your own risk, and SX Consent may process or preserve that message for support, legal, security or compliance purposes.

  1. SMS Is Not an Emergency Service

SX Consent SMS messaging is not a 911 service, emergency dispatch service, crisis hotline, public safety service, law enforcement service, medical emergency service or guaranteed real-time safety monitoring service.

Do not rely on SMS messages from SX Consent for emergency help.

If you are in danger or need immediate assistance, call 911 or your local emergency number.

SX Consent does not guarantee that SMS messages will be delivered, read, received, acted upon or escalated in real time.

  1. SMS Is Not Legal, Medical or Safety Advice

SMS messages from SX Consent are not legal advice, medical advice, mental health advice, safety advice, diagnosis, treatment, legal representation, emergency response or guaranteed evidence.

SMS messages may provide operational alerts, verification codes, account notices or app instructions.

You should consult qualified professionals for legal, medical, safety or emergency matters.

  1. Prohibited SMS Use

You must not use SX Consent SMS systems to:

  • harass anyone;
  • impersonate another person;
  • verify a phone number you do not control;
  • send false information;
  • facilitate fraud;
  • bypass opt-out rules;
  • evade verification controls;
  • register multiple fake accounts;
  • threaten, coerce, blackmail or extort another person;
  • send illegal content;
  • send explicit content;
  • send health data by SMS unnecessarily;
  • interfere with delivery systems;
  • abuse support channels;
  • trigger excessive verification codes;
  • attempt SMS pumping or traffic fraud;
  • violate carrier rules;
  • violate Twilio rules;
  • violate TCPA, CTIA or applicable messaging laws.

SX Consent may suspend, block, restrict or terminate accounts suspected of SMS misuse.

  1. SMS Pumping, Fraud and Abuse Prevention

SX Consent may use technical and operational controls to detect, prevent or limit:

  • SMS pumping;
  • artificial traffic inflation;
  • verification abuse;
  • SIM farms;
  • bot activity;
  • fake accounts;
  • repeated failed verification attempts;
  • suspicious country or carrier patterns;
  • automated abuse;
  • excessive code requests;
  • suspicious re-opt-ins;
  • carrier fraud;
  • account takeover attempts.

We may block, rate-limit, delay, restrict, charge, suspend, terminate or preserve records related to suspected SMS abuse.

  1. Consent Evidence and Compliance Audits

SX Consent may be required to show evidence of SMS consent to providers, carriers, regulators, payment processors, app stores, legal authorities or dispute administrators.

You agree that SX Consent may preserve and disclose consent evidence as reasonably necessary for:

  • A2P 10DLC registration;
  • carrier compliance;
  • Twilio compliance;
  • TCPA compliance;
  • CTIA best practices;
  • provider audits;
  • legal defense;
  • fraud prevention;
  • chargeback defense;
  • dispute resolution;
  • law enforcement or court requests;
  • platform safety.
  1. Carrier and Provider Requirements

SX Consent SMS messages may be subject to requirements imposed by:

  • Twilio;
  • mobile carriers;
  • The Campaign Registry;
  • CTIA guidelines;
  • FCC/TCPA rules;
  • Apple App Store;
  • Google Play;
  • payment processors;
  • identity verification providers;
  • applicable law.

Provider or carrier requirements may change over time. SX Consent may update these SMS Terms, message flows, opt-in screens, templates, sending frequency, delivery methods, sender numbers or program structure to maintain compliance.

  1. Message Templates and Content Control

SX Consent may use standardized SMS templates to reduce risk and protect sensitive information.

You may not modify, inject, manipulate or cause SX Consent to send SMS content that violates these SMS Terms or any provider policy.

SX Consent may refuse to send or may suppress messages that contain prohibited language, sensitive context, unsupported content, carrier-risk terms or content that could violate A2P rules, Twilio policies, carrier rules or applicable law.

  1. Changes to Your Messaging Preferences

You may be able to manage SMS preferences in the SX Consent app or website.

Changes may not take effect instantly. Some provider systems, carrier systems or cached message queues may take time to update.

If you opt out, SX Consent will process the opt-out according to applicable provider rules and may send one final confirmation message.

  1. Account Deletion and SMS Records

Deleting your SX Consent account does not automatically delete all SMS records.

SX Consent may retain SMS consent, opt-out, verification, delivery, audit, support and compliance records as reasonably necessary for:

  • legal compliance;
  • A2P compliance;
  • Twilio compliance;
  • carrier compliance;
  • fraud prevention;
  • dispute resolution;
  • security investigations;
  • chargeback defense;
  • account deletion proof;
  • data deletion proof;
  • enforcement of Terms and Conditions.

Account deletion does not create a refund right.

  1. Data Deletion and SMS Records

You may request deletion of eligible SMS-related data through the Data Deletion process.

SX Consent may deny, delay, limit or partially fulfill deletion requests where SMS records must be retained for:

  • consent evidence;
  • opt-out evidence;
  • provider compliance;
  • legal compliance;
  • fraud prevention;
  • security;
  • audit logs;
  • dispute resolution;
  • chargeback defense;
  • legal claims;
  • preservation of rights.

Where appropriate, SX Consent may restrict, archive, de-identify or minimize records instead of deleting them.

  1. No Warranty for SMS Messaging

SX Consent SMS messaging is provided “as is” and “as available.”

SX Consent does not warrant that:

  • SMS will always be available;
  • SMS will always be delivered;
  • SMS will be delivered immediately;
  • SMS will be delivered in order;
  • SMS will be supported by every carrier;
  • SMS will be supported in every country;
  • SMS will be free from filtering;
  • SMS will be free from delays;
  • verification codes will always arrive;
  • SMS will prevent unauthorized access;
  • SMS will prevent harm;
  • SMS will prevent missed notices;
  • SMS will prevent disputes;
  • SMS will prevent legal claims;
  • SMS will function during emergencies.
  1. Limitation of Liability for SMS

To the maximum extent permitted by law, SX Consent, Beniquez Sanchez and Company LLC, BS and Co AI Labs, their affiliates, owners, officers, directors, employees, contractors, agents, providers, licensors and successors are not liable for:

  • delayed SMS;
  • undelivered SMS;
  • blocked SMS;
  • filtered SMS;
  • misrouted SMS;
  • messages sent to a number you failed to update;
  • carrier fees;
  • data charges;
  • roaming charges;
  • device notification exposure;
  • unauthorized access to your phone;
  • carrier outages;
  • provider outages;
  • SMS verification failures;
  • missed notices;
  • closure deadline issues;
  • session readiness delays;
  • security consequences caused by user failure to secure devices;
  • inability to use features after opt-out;
  • any indirect, incidental, consequential, special, punitive or exemplary damages related to SMS.
  1. Indemnification for SMS Misuse

You agree to defend, indemnify and hold harmless SX Consent, Beniquez Sanchez and Company LLC, BS and Co AI Labs and their affiliates from claims, damages, losses, penalties, fees, investigations, fines, chargebacks, provider claims, carrier claims, legal costs and attorney’s fees arising from:

  • your misuse of SMS;
  • your use of a phone number you do not own or control;
  • your failure to update your phone number;
  • your fraudulent opt-in;
  • your false consent;
  • your violation of these SMS Terms;
  • your violation of SMS laws;
  • your violation of carrier or provider rules;
  • your SMS pumping or traffic fraud;
  • your unauthorized account activity;
  • your harassment or abuse through SMS-related features;
  • your chargebacks or disputes related to SMS features.
  1. Dispute Resolution

SMS-related disputes are subject to the dispute resolution, binding arbitration, class action waiver, jury trial waiver, governing law, venue, limitation of liability and related provisions in the SX Consent Terms and Conditions.

By opting into SX Consent SMS messages, you agree that SMS-related disputes must be handled according to those provisions unless applicable law requires otherwise.

  1. Changes to These SMS Terms

SX Consent may update these SMS Terms at any time to reflect changes in:

  • law;
  • TCPA requirements;
  • FCC rules;
  • CTIA guidelines;
  • Twilio requirements;
  • A2P 10DLC requirements;
  • carrier requirements;
  • Apple App Store requirements;
  • Google Play requirements;
  • platform features;
  • message templates;
  • privacy practices;
  • security practices;
  • provider requirements;
  • business operations.

The “Last Updated” date indicates when these SMS Terms were last revised.

Continued use of SX Consent SMS features after updated SMS Terms become effective means you accept the updated SMS Terms where permitted by law.

  1. Final SMS Consent Acknowledgment

By opting into SMS messaging, you acknowledge and agree that:

  1. You are at least 18 years old.
  2. You are the owner or authorized user of the mobile number you provide.
  3. SX Consent may send transactional and operational SMS messages.
  4. Message frequency varies.
  5. Message and data rates may apply.
  6. You may reply STOP to opt out.
  7. You may reply HELP for help.
  8. Opting out may limit or disable certain SX Consent features.
  9. SX Consent SMS is not an emergency service.
  10. SX Consent SMS is not legal, medical or safety advice.
  11. SX Consent does not guarantee delivery of SMS messages.
  12. SX Consent does not sell or share SMS opt-in data for third-party marketing.
  13. You must update your number if it changes.
  14. You must not use SMS features for fraud, harassment or abuse.
  15. SMS-related records may be retained for compliance, consent evidence, fraud prevention, security and dispute resolution.
