SX Consent Application

This Payment, Cancellation and Refund Policy (“Policy”) applies to SX Consent Application (“SX Consent,” “we,” “us,” or “our”), operated by Beniquez Sanchez and Company LLC and created by BS and Co AI Labs.

This Policy governs payments, subscriptions, purchases, renewals, cancellations, refund requests, chargebacks, payment disputes, subscription access, billing issues, account deletion consequences, data deletion consequences, payment-provider records, app-store purchases, web purchases, enterprise or VIP purchases, and related payment matters involving SX Consent.

By creating an account, subscribing, purchasing access, initiating payment, using a paid feature, starting a trial, redeeming a promotional offer, using SX Consent after payment, deleting your account after purchase, requesting data deletion after purchase, or otherwise using any paid SX Consent service, you agree to this Policy.

If you do not agree with this Policy, do not purchase, subscribe to, pay for, or use paid SX Consent features.

  1. Relationship to Other SX Consent Policies

This Policy supplements and is incorporated into the following SX Consent policies and disclosures:

  • Terms and Conditions;
  • Privacy Policy;
  • Sensitive Data Consent;
  • Health Data Handling Policy;
  • SMS Terms;
  • Account Deletion Policy;
  • Data Deletion Policy;
  • any in-app subscription disclosure;
  • any Apple App Store or Google Play subscription disclosure;
  • any Stripe, RevenueCat, Apple, Google, or payment-provider disclosure;
  • any plan-specific, enterprise, VIP, promotional, or written payment terms.

If there is a conflict between this Policy and another SX Consent policy, the provision most specific to the payment, cancellation, refund, chargeback, subscription, entitlement, billing, or payment-provider issue will control, unless applicable law, Apple App Store rules, Google Play rules, Stripe rules, RevenueCat rules, or another controlling provider requirement requires otherwise.

  1. Nature of SX Consent Services

SX Consent provides access to private digital services and app-based workflows for verified adults. These may include, depending on plan, platform, account status, subscription status, feature availability, jurisdiction, provider availability, and app version:

  • account creation and account-readiness workflows;
  • adult eligibility and identity-readiness workflows;
  • phone and email verification;
  • private requirement profiles;
  • Sensitive Data Consent workflows;
  • optional personal health-related readiness workflows, where enabled;
  • private invitation workflows between app users;
  • Cross-Intake and compatibility review workflows;
  • One-Time Private Invitation Agreement generation and review;
  • digital signature workflows;
  • invitation-event timeline and participation-status controls;
  • location-readiness or invitation-zone workflows, where applicable;
  • SMS, email, and in-app operational notices;
  • post-invitation closure workflows;
  • Evidence Vault access and protected record package metadata;
  • protected record export or verification features;
  • subscription-based premium features;
  • future VIP, professional, or enterprise features.

SX Consent is a digital service. Once access, account functionality, subscription entitlement, verification workflow, agreement generation, protected record functionality, server processing, digital records, private invitation workflows, or other app services are made available, the service is considered delivered in whole or in part.

  1. No Physical Returns

SX Consent does not sell physical goods through this Policy.

There are no physical returns, exchanges, shipping returns, restocking returns, or return merchandise authorizations for SX Consent digital services.

The title “Refund & Returns Policy” may appear on the website for website compatibility, SEO, provider review, or user navigation purposes, but SX Consent’s service is digital and subscription-based.

  1. Payment Processing

Payments may be processed through one or more authorized third-party payment channels, including:

  • Apple App Store;
  • Google Play;
  • Stripe;
  • RevenueCat or similar subscription infrastructure;
  • credit card processors;
  • debit card processors;
  • digital wallet providers;
  • banking networks;
  • subscription billing providers;
  • app store billing systems;
  • enterprise billing systems;
  • other authorized payment providers.

Charges may appear on statements under names such as SX Consent, Beniquez Sanchez and Company LLC, BS and Co AI Labs, B and S LLC, Apple, Google, Stripe, RevenueCat, or another authorized payment processor or merchant descriptor.

You authorize SX Consent, Beniquez Sanchez and Company LLC, Apple, Google, Stripe, RevenueCat, or the applicable payment processor to charge your payment method or app-store account for all amounts due, including subscriptions, renewals, taxes, fees, and other charges associated with your selected plan.

  1. Payment Information

SX Consent does not intend to store full payment card numbers or full card security codes on its own servers.

Payment information may be collected, processed, stored, tokenized, retained, or transmitted by Apple, Google, Stripe, RevenueCat, banks, card networks, app stores, or other payment processors according to their own terms, privacy policies, security practices, fraud-prevention rules, and legal obligations.

You are responsible for reviewing the terms and privacy policies of the payment provider used for your purchase.

  1. Subscription Plans

SX Consent may offer monthly, quarterly, annual, promotional, trial, premium, VIP, web, mobile, Apple App Store, Google Play, Stripe, RevenueCat-managed, professional, or enterprise subscription plans.

Subscription plans may vary by price, billing period, platform, country, currency, tax treatment, included features, available features, account-readiness requirements, provider availability, app-store requirements, promotional terms, grandfathered terms, enterprise terms, and payment-channel rules.

Available features may change over time. A subscription gives you access to applicable SX Consent features during the paid subscription period, subject to account status, verification status, subscription status, plan limits, feature availability, provider availability, compliance requirements, permissions, app readiness, payment status, and these policies.

  1. Billing in Advance

SX Consent subscriptions and paid digital services are generally billed in advance.

By purchasing or subscribing, you agree that:

  • payment is due before access is provided;
  • subscription fees are charged at the beginning of the billing period;
  • renewal charges may occur automatically unless canceled in time according to the applicable platform rules;
  • the applicable payment provider may attempt to charge your payment method or app-store account;
  • access may be denied, suspended, restricted, downgraded, or terminated if payment fails;
  • paid amounts are final and non-refundable except where required by law or controlling provider policy.
  1. Automatic Renewal

Unless stated otherwise in the applicable purchase flow, subscriptions may automatically renew at the end of each billing period until canceled.

By purchasing an automatically renewing subscription, you authorize recurring charges for each renewal period.

The renewal amount, billing frequency, renewal date, receipt handling, cancellation deadline, and entitlement status may depend on the subscription plan, platform, country, currency, taxes, app store rules, payment provider rules, promotional offer, and subscription infrastructure.

You are responsible for knowing your renewal date and canceling before renewal if you do not want to be charged again.

  1. Subscription Disclosure Requirements

Before purchase confirmation, SX Consent or the applicable app-store purchase sheet may display subscription information such as subscription title, duration, price, billing period, renewal terms, cancellation method, available offers, and applicable links to the Privacy Policy and Terms of Use / EULA.

Terms of Use / EULA: https://sxconsent.com/terms-and-conditions/

Privacy Policy: https://sxconsent.com/privacy-policy/

For Apple App Store purchases, payment is charged to the user’s Apple ID account at confirmation of purchase, and subscription management occurs through Apple ID subscription settings according to Apple’s rules.

For Google Play purchases, payment and subscription management occur through Google Play according to Google’s rules.

For web or Stripe purchases, payment and cancellation are handled through the applicable SX Consent or provider-controlled process.

  1. Cancellation of Subscription

You may cancel your subscription according to the method required by the platform where you purchased it.

If purchased through Apple App Store, you must cancel through Apple subscription settings.

If purchased through Google Play, you must cancel through Google Play subscription settings.

If purchased through Stripe, web checkout, or another authorized web payment method, you must cancel through the cancellation method provided by SX Consent or the applicable payment provider.

If purchased through an enterprise, VIP, professional, or special agreement, cancellation may be governed by the applicable written agreement.

Canceling a subscription prevents future renewal. It does not automatically refund amounts already paid.

  1. Access After Cancellation

If you cancel your subscription, your paid access will generally remain active until the end of the paid billing period, unless:

  • the app store or payment provider removes access;
  • a refund is issued and entitlement is revoked;
  • your account is terminated for cause;
  • you violate the Terms and Conditions or incorporated policies;
  • fraud, abuse, payment misconduct, or identity mismatch is detected;
  • required verification fails;
  • legal, security, operational, or provider requirements require suspension;
  • SX Consent is discontinued;
  • app store or payment-provider rules provide otherwise;
  • applicable law requires otherwise.

At the end of the paid period, the subscription will not renew and paid features may be disabled, restricted, downgraded, or unavailable.

  1. Strict No-Refund Policy

All payments to SX Consent, Beniquez Sanchez and Company LLC, BS and Co AI Labs, or any authorized SX Consent payment channel are final and non-refundable, except where a refund is required by applicable law or by a controlling Apple, Google, Stripe, RevenueCat, or payment-provider policy.

This no-refund policy applies to:

  • monthly subscriptions;
  • quarterly subscriptions;
  • annual subscriptions;
  • trial conversions;
  • automatic renewals;
  • web subscriptions;
  • Apple App Store subscriptions;
  • Google Play subscriptions;
  • Stripe payments;
  • RevenueCat-managed purchases;
  • premium features;
  • VIP, professional, or enterprise features;
  • digital services;
  • identity-readiness features;
  • app-readiness features;
  • Evidence Vault features;
  • protected record package features;
  • agreement generation features;
  • protected invitation workflow features;
  • closure workflow features;
  • location-readiness features;
  • SMS-related operational readiness;
  • account services;
  • unused access or partially used access;
  • unused billing periods or partially used billing periods;
  • user dissatisfaction;
  • failure to use the service;
  • failure to cancel before renewal;
  • misunderstanding of subscription terms;
  • account deletion or data deletion requests;
  • suspension or termination;
  • verification failure;
  • unsupported device issues;
  • disabled or unavailable permissions;
  • declined or canceled invitations;
  • incompatible Cross-Intake results;
  • blocked or unresolved protected invitation workflows;
  • inability to start, continue, complete, or close a protected invitation workflow;
  • inability to obtain a desired legal, privacy, relationship, reputational, or documentation result;
  • inability to export or use records for a desired purpose;
  • third-party refusal to accept protected records;
  • another user’s failure to participate, refusal to sign, cancellation, misconduct, or decision to end participation;
  • app store delays;
  • provider outages;
  • SMS delivery failures;
  • email delivery failures;
  • identity verification delays;
  • payment provider delays;
  • platform review delays;
  • ordinary feature evolution, feature limitations, or product changes.
  1. No Refund for Account Deletion

Deleting your SX Consent account does not entitle you to a refund.

If you delete your account during a paid subscription period:

  • your subscription may remain active until the end of the paid period if supported by the payment platform;
  • access may be restricted or unavailable because the account was deleted;
  • you remain responsible for canceling future renewals through Apple, Google, Stripe, or the applicable payment channel;
  • prior payments remain non-refundable;
  • deletion does not cancel past charges;
  • deletion does not void this Policy;
  • deletion does not erase payment obligations already incurred.

You are responsible for canceling your subscription before deleting your account if you do not want future charges.

  1. No Refund for Data Deletion Requests

Submitting a data deletion request does not entitle you to a refund.

A data deletion request may limit, disable, restrict, or remove your ability to use SX Consent features, but it does not reverse prior payments, subscriptions, renewals, charges, taxes, or payment-provider records.

Some records may be retained as described in the Data Deletion Policy, Privacy Policy, Terms and Conditions, Sensitive Data Consent, Health Data Handling Policy, and applicable law.

  1. No Refund for Subscription Cancellation

Canceling a subscription only prevents future renewals.

Cancellation does not create a right to:

  • a full refund;
  • a partial refund;
  • a prorated refund;
  • a credit;
  • reimbursement;
  • compensation;
  • charge reversal;
  • extension;
  • account credit;
  • future discount.

If you cancel, you may continue to have access until the end of the paid billing period where technically and legally available, unless the subscription is refunded, revoked, terminated for cause, or controlled differently by the payment platform.

  1. No Prorated Refunds

SX Consent does not provide prorated refunds for unused time.

No prorated refunds will be issued for unused days, weeks, months, quarters, years, plan features, Evidence Vault features, protected invitation workflows, invitations, exports, protected record benefits, subscription benefits, inability to use features due to account unreadiness, failure to complete verification, failure to maintain required permissions, or failure to cancel before renewal.

  1. No Refund for Feature Changes

SX Consent may add, modify, limit, remove, suspend, rename, redesign, replace, or discontinue features, plans, providers, workflows, integrations, app experiences, website experiences, agreement templates, protected record features, or subscription tiers.

You are not entitled to a refund because a feature changed, was removed, was delayed, is evolving, is unavailable in your jurisdiction, requires additional verification, requires additional consent, requires a higher plan, is unavailable due to technical limitations, or is affected by Apple, Google, Stripe, Twilio, RevenueCat, identity verification, payment, SMS, email, mapping, hosting, or provider requirements.

Feature changes may be made for legal, privacy, security, operational, App Store, Google Play, payment, provider, business, fraud-prevention, user-protection, or compliance reasons.

  1. No Refund for Legal, Privacy, Health, Relationship, Reputation, or Protected Record Outcomes

SX Consent does not guarantee legal, privacy, health, relationship, reputation, documentation, protected record, or real-world outcomes.

No refund will be issued because:

  • a dispute occurred;
  • another user made a claim;
  • another user refused to comply;
  • a record was not accepted by a court, attorney, employer, media outlet, platform, insurer, payment provider, app store, or third party;
  • you did not obtain a desired legal, privacy, reputation, relationship, documentation, or health-related result;
  • another user declined to sign;
  • another user did not complete closure;
  • another user misused information;
  • another user breached a clause;
  • another user posted on social media;
  • another user disclosed information outside the app;
  • another user logged an early event departure, temporarily left, returned, or manually ended participation.

SX Consent provides private documentation workflows and contextual protected records. It does not sell guaranteed outcomes.

  1. No Refund for User Error

No refund will be issued due to user error, including:

  • entering the wrong email;
  • entering the wrong phone number;
  • forgetting to cancel;
  • failing to read the terms;
  • failing to read renewal disclosures;
  • failing to check billing date;
  • failing to update payment method;
  • failing to secure an account;
  • failing to complete onboarding;
  • failing identity verification;
  • failing phone verification;
  • failing email verification;
  • disabling SMS, email, in-app notices, location, or required device permissions;
  • losing device access;
  • changing phone number;
  • deleting or uninstalling the app;
  • deleting an account;
  • misusing the app;
  • not understanding app limitations;
  • not using the purchased subscription.
  1. No Refund for Third-Party Provider Issues

SX Consent is not responsible for third-party provider policies, failures, outages, delays, denials, limitations, account actions, or decisions.

No refund will be issued due to Apple App Store decisions, Google Play decisions, Stripe decisions, RevenueCat decisions, Twilio delivery issues, email provider issues, identity verification provider delays, payment processor holds, banking issues, card issuer declines, device operating system restrictions, app store review delays, app store account issues, mobile carrier issues, internet connectivity issues, mapping or geolocation provider issues, hosting provider issues, or third-party service outages.

Where Apple, Google, Stripe, or another payment provider controls the refund process, that provider’s decision may be final as to the transaction processed through that provider.

  1. App Store and Google Play Purchases

Purchases made through Apple App Store or Google Play are governed by the applicable app store’s payment, subscription, cancellation, and refund rules.

SX Consent may not have the ability to issue, approve, deny, reverse, or control refunds for purchases made through Apple App Store or Google Play.

If you purchased through Apple, you may need to contact Apple or use Apple’s refund request process for refund requests.

If you purchased through Google Play, you may need to contact Google Play or use Google’s refund request process for refund requests.

SX Consent may provide support information, receipt review, entitlement support, or provider communication where appropriate, but SX Consent does not guarantee that Apple or Google will issue a refund.

  1. Web Purchases and Stripe Purchases

Purchases made through the SX Consent website, Stripe, or another authorized web payment processor are governed by this Policy, the Terms and Conditions, applicable payment provider rules, and applicable law.

Unless required by law, Stripe and web purchases are final and non-refundable.

We may deny refund requests that are inconsistent with this Policy.

We may refuse, cancel, hold, review, or block transactions suspected of fraud, abuse, policy violation, chargeback abuse, identity mismatch, prohibited use, account misuse, payment risk, security risk, operational risk, or legal risk.

  1. RevenueCat and Subscription Infrastructure

SX Consent may use RevenueCat or similar subscription infrastructure to manage subscriptions, entitlements, app store receipts, web billing, access status, offer status, subscription lifecycle events, renewal state, cancellation state, and provider signals.

RevenueCat or similar providers may reflect whether a subscription is active, canceled, expired, refunded, in grace period, billing retry, paused, trialing, transferred, revoked, upgraded, downgraded, or otherwise controlled by the app store or payment provider.

A cancellation event, refund event, expiration event, billing retry event, grace period event, entitlement event, or revocation signal may affect access immediately or at the end of a billing period depending on platform rules and provider signals.

  1. Free Trials and Promotional Offers

SX Consent may offer free trials, discounted trials, promotional offers, coupons, early-access offers, introductory pricing, win-back offers, or limited-time pricing, where permitted by the applicable platform and provider rules.

Promotional offers may be limited by user, account, device, payment method, jurisdiction, platform, plan, time period, availability, provider restrictions, app store rules, fraud-prevention rules, and eligibility conditions.

If a free trial converts into a paid subscription, you will be charged unless you cancel before the required deadline.

You are responsible for canceling before the trial or promotional period ends. Failure to cancel before trial conversion or renewal does not entitle you to a refund.

SX Consent may modify, withdraw, revoke, refuse, or limit promotional offers at any time, subject to applicable law and controlling provider rules.

  1. Price Changes

SX Consent may change subscription prices, plan structures, billing periods, included features, plan names, feature limits, service packages, promotional pricing, or subscription tiers.

Where required, we or the applicable app store or payment processor may provide notice of price changes.

If you do not agree to a price change, you must cancel before the next renewal.

Continuing to use SX Consent after a price change takes effect may result in billing at the updated price, subject to app store or payment-provider rules.

  1. Taxes and Fees

Prices may not include taxes, VAT, sales tax, use tax, digital services tax, app store fees, payment processing fees, bank fees, foreign exchange fees, carrier fees, mobile data fees, or other charges.

You are responsible for all applicable taxes and fees.

SX Consent, Apple, Google, Stripe, RevenueCat, or another payment provider may calculate, collect, remit, or display taxes based on available information and applicable rules.

Tax treatment may vary by jurisdiction and may change over time.

  1. Failed Payments, Billing Retry and Grace Periods

If a payment fails, SX Consent or the applicable payment provider may retry payment, notify you, place the subscription in grace period, restrict access, suspend features, downgrade your account, cancel renewal, terminate access, require updated payment information, preserve records, or pursue amounts owed.

Apple, Google, Stripe, RevenueCat, or another payment provider may offer billing retry, grace periods, account hold, pause, recovery, retry attempts, or similar subscription lifecycle features. These features are controlled by provider rules and may vary by platform, country, purchase channel, subscription product, and payment method.

SX Consent does not guarantee a grace period, billing retry period, reactivation period, entitlement recovery, or continued access after failed payment.

You remain responsible for unpaid amounts, taxes, chargeback fees, payment processor fees, collection costs, and other amounts permitted by law.

  1. Account Suspension for Nonpayment

SX Consent may suspend, restrict, downgrade, or terminate access if payment fails, a chargeback occurs, a payment dispute is initiated, fraud is suspected, subscription expires, required payment method is invalid, app store receipt is invalid, entitlement cannot be verified, provider indicates refund or revocation, or account violates payment terms.

Suspension, restriction, downgrade, or termination for nonpayment does not create a refund right.

  1. Fraud Prevention

SX Consent reserves the right to investigate transactions and accounts for fraud, abuse, identity mismatch, unauthorized payment use, chargeback abuse, refund abuse, suspicious behavior, account takeover risk, duplicate-account risk, payment-risk indicators, or violations of this Policy.

We may request additional verification, refuse payment, cancel a transaction, block a payment method, suspend an account, terminate an account, preserve records, submit evidence to payment processors, report suspicious activity, cooperate with financial institutions, providers, law enforcement, app stores, or legal authorities, and pursue collection, arbitration, or legal remedies.

  1. Chargeback and Payment Dispute Policy

You agree not to initiate false, fraudulent, abusive, misleading, retaliatory, bad-faith, or improper chargebacks, reversals, disputes, claims, payment complaints, or refund demands.

Before initiating a chargeback or payment dispute, you must contact Click Here and allow SX Consent a reasonable opportunity to review and respond.

If you initiate a chargeback, reversal, refund claim, or payment dispute, you authorize SX Consent and Beniquez Sanchez and Company LLC to submit evidence to the payment processor, bank, card issuer, app store, payment network, arbitration body, dispute administrator, or provider, including:

  • account records;
  • transaction records;
  • subscription records;
  • renewal disclosures;
  • cancellation records;
  • refund policy records;
  • Terms and Conditions acceptance records;
  • Privacy Policy acceptance records;
  • Sensitive Data Consent acceptance records;
  • SMS Terms acceptance records;
  • login logs;
  • IP addresses;
  • device metadata;
  • user agent data;
  • purchase timestamps;
  • app usage records;
  • entitlement records;
  • verification status;
  • communication records;
  • support tickets;
  • account deletion records;
  • data deletion records;
  • evidence of access;
  • provider records;
  • any other information reasonably relevant to the dispute, subject to applicable law and privacy controls.
  1. Consequences of Chargebacks

If you initiate a chargeback or payment dispute, SX Consent may suspend your account, terminate your account, revoke access, block future purchases, block your device or payment method, restrict protected record exports, place the account in payment dispute status, refuse future service, preserve records, dispute the chargeback, recover administrative costs, recover payment processor fees, recover chargeback fees, recover collection costs, recover attorney’s fees, pursue arbitration or legal remedies, and report abuse where permitted.

You remain responsible for any unpaid amounts and costs caused by chargebacks, reversals, collection activity, or payment disputes, to the maximum extent permitted by law.

  1. Refund Requests

Refund requests must be submitted to the payment channel where the purchase occurred.

For Apple purchases, contact Apple or use Apple’s refund request process.

For Google Play purchases, contact Google Play or use Google’s refund request process.

For Stripe or web purchases, contact Click Here.

A refund request should include full legal name, account email, phone number associated with the account, transaction date, payment platform, order ID or receipt, subscription plan, reason for request, and supporting documentation.

Submitting a refund request does not guarantee a refund. SX Consent may deny refund requests that are inconsistent with this Policy.

  1. Limited Exceptions Required by Law

Nothing in this Policy limits any non-waivable right you may have under applicable law.

If applicable law requires a refund, cancellation right, cooling-off period, withdrawal right, charge reversal, or other consumer protection remedy that cannot be waived, SX Consent will comply to the extent required.

Where permitted by law, this Policy applies fully.

  1. Refunds Issued by SX Consent in Exceptional Cases

SX Consent may, in its sole discretion, issue a refund, credit, extension, or accommodation in exceptional circumstances where SX Consent controls the transaction and is permitted to act by the applicable payment provider.

Any discretionary refund, credit, extension, or accommodation is not required, does not create a precedent, does not waive this Policy, does not require future refunds, may be conditioned on account closure, may revoke access immediately, may require written settlement or release, and may be denied for any reason permitted by law.

A discretionary refund on one transaction does not require a refund on any other transaction, renewal, subscription period, plan, account, user, platform, or future request.

  1. Effect of Refund on Access

If a refund is issued, SX Consent may immediately revoke subscription access, terminate premium features, revoke protected record export access, downgrade the account, disable paid features, cancel renewal, restrict future purchases, preserve records as required, maintain protected record integrity, and keep audit logs.

Refunded access may not be restored unless repurchased and approved.

If a refund is issued by Apple, Google, Stripe, RevenueCat, a card issuer, or another payment provider, entitlement changes may be based on provider signals, app-store receipts, server notifications, or subscription infrastructure records.

  1. Subscription Upgrades and Downgrades

SX Consent may allow upgrades or downgrades between plans.

Billing effects may vary by platform, payment provider, app store, plan structure, promotional offer, subscription group, and subscription infrastructure.

An upgrade or downgrade may be effective immediately, at the end of the current billing period, at the next renewal date, or according to Apple, Google, Stripe, RevenueCat, or provider rules.

No refund is guaranteed for downgrades. No prorated credit is guaranteed unless required by law or processed by the controlling payment provider.

  1. Inability to Use Features Due to Readiness Requirements

Certain SX Consent features may require identity verification, adult verification, phone verification, email verification, SMS opt-in, in-app notice readiness, location permission, device linking, PIN setup, Sensitive Data Consent, Health Data Handling consent where applicable, account readiness, active subscription, compatible device, supported jurisdiction, provider availability, and required app version.

No refund will be issued because you cannot or do not satisfy these readiness requirements, because another user cannot or does not satisfy them, or because provider requirements prevent completion.

  1. Jurisdiction and Availability Limitations

SX Consent may not be available in every country, state, territory, device, platform, payment method, language, or jurisdiction.

Features may be limited due to law, provider restrictions, Apple requirements, Google requirements, Twilio requirements, Stripe requirements, identity verification availability, SMS availability, payment availability, adult eligibility requirements, privacy or security considerations, technical constraints, or operational readiness.

No refund will be issued because a feature is unavailable in your jurisdiction after purchase unless required by law or controlling provider policy.

  1. Enterprise, VIP and Custom Plans

SX Consent may offer enterprise, B2B, VIP, professional, high-security, reputation-sensitive, concierge, or custom plans.

Unless a separate written agreement signed by Beniquez Sanchez and Company LLC expressly states otherwise, all enterprise, VIP, professional, and custom payments are non-refundable; setup fees are non-refundable; onboarding fees are non-refundable; consulting fees are non-refundable; configuration fees are non-refundable; custom development fees are non-refundable; administrative fees are non-refundable; unused services are non-refundable; partial services are fully payable; and cancellation prevents future billing only.

Custom plans may involve separate identity-readiness, privacy, confidentiality, support, implementation, configuration, training, or professional-service terms.

  1. Gift Codes, Credits and Promotional Access

If SX Consent offers gift codes, credits, coupons, promotional access, vouchers, referral benefits, or account credits, they have no cash value, are non-refundable, may expire, may be revoked for abuse, may be limited to one account, may not be transferred, may not be resold, may not be redeemed for cash, and may be subject to additional terms.

Promotional access does not create a right to continued free access, future discounts, paid entitlements, or refunds.

  1. Taxes, Accounting and Records

SX Consent may retain transaction records, invoices, receipts, tax records, billing metadata, payment processor records, subscription events, entitlement records, refund records, chargeback records, and related documents as needed for accounting, tax, fraud prevention, legal compliance, chargeback defense, audit, app store compliance, provider compliance, and dispute resolution.

These records may be retained after account deletion or data deletion requests where permitted or required by law, provider obligations, tax rules, audit requirements, payment processing rules, or legitimate legal interests.

  1. No Waiver of Payment Obligations

Failure by SX Consent to immediately enforce any payment term does not waive our right to enforce that term later.

Accepting late payment, partial payment, disputed payment, payment after suspension, or provider-adjusted payment does not waive our rights.

A refund denial, refund approval, chargeback response, provider decision, account suspension, or payment compromise does not modify this Policy unless Beniquez Sanchez and Company LLC expressly agrees in writing.

  1. Termination for Cause and Payment Consequences

SX Consent may terminate or suspend your account for cause under the Terms and Conditions and incorporated policies.

Termination for cause does not entitle you to a refund.

Cause may include violating Terms, violating policies, payment fraud, chargeback abuse, identity fraud, underage use, misuse of sensitive data, harassment, coercion, prohibited conduct, protected record manipulation, unlawful use, provider violations, creating legal risk, creating security risk, creating reputational risk, creating operational risk, or interfering with SX Consent, users, providers, contractors, directors, employees, affiliates, successors, assigns, or Beniquez Sanchez and Company LLC.

  1. Discontinuation of Service

SX Consent may discontinue, sunset, pause, suspend, migrate, replace, or materially change the service or any feature.

If SX Consent discontinues a paid service entirely before the end of a paid period, SX Consent may provide notice and may determine, in its discretion or as required by law, whether to provide continued access, migration, credit, extension, substitute access, or refund.

No refund is guaranteed unless required by law or controlling payment provider policy.

  1. Evolving Features and Access Limitations

SX Consent features, plans, provider integrations, agreement templates, app experiences, website experiences, protected record features, payment flows, subscription infrastructure, and access controls may evolve over time.

You acknowledge that features may be incomplete, delayed, changed, limited, interrupted, renamed, removed, reset, disabled, or unavailable during ordinary product operation, provider changes, legal updates, compliance updates, app-store review cycles, operating system changes, or infrastructure changes.

No refund will be issued due to ordinary feature evolution, access limitations, version differences, provider dependencies, device limitations, app-store review timing, or product changes, unless required by law or controlling provider policy.

  1. User Responsibility to Review Terms Before Purchase

Before purchasing or subscribing, you are responsible for reviewing this Policy, Terms and Conditions, Privacy Policy, Sensitive Data Consent, Health Data Handling Policy, SMS Terms, Account Deletion Policy, Data Deletion Policy, plan details, app store subscription disclosures, cancellation instructions, renewal date, billing period, price, taxes, provider terms, and feature limitations.

By purchasing, you confirm that you had the opportunity to review these terms and accept the no-refund policy to the maximum extent permitted by law.

Failure to read, understand, save, or review these terms before purchase does not create a refund right.

  1. Billing Support

For billing questions related to SX Consent web purchases, legal payment issues, privacy-related billing questions, Apple App Store purchases or Google Play purchases contact Support: Click Here.

SX Consent may request reasonable verification before discussing billing, account, purchase, refund, entitlement, or subscription information.

  1. Governing Law

This Policy is governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-law principles, except where non-waivable consumer protection law requires otherwise.

For Puerto Rico operations, applicable laws of the Commonwealth of Puerto Rico may also apply where legally required.

Nothing in this section limits non-waivable consumer rights that apply by law.

  1. Dispute Resolution

Payment disputes are subject to the dispute resolution, binding arbitration, class action waiver, governing law, venue, limitation of liability, indemnification, release, and related provisions in the SX Consent Terms and Conditions.

By purchasing or subscribing, you agree that payment disputes must be handled according to those provisions unless applicable law requires otherwise.

This section does not prevent you from using a payment provider’s required dispute process where that process cannot legally be waived; however, you agree not to misuse provider dispute systems, chargeback systems, or app-store refund systems in bad faith.

  1. Changes to This Policy

SX Consent may update this Payment, Cancellation and Refund Policy at any time to reflect changes in law, Apple requirements, Google requirements, Stripe requirements, RevenueCat requirements, payment provider requirements, subscription plans, pricing, features, fraud prevention, chargeback processes, business operations, app store rules, tax requirements, platform policies, provider integrations, or operational needs.

The Last Updated date indicates when this Policy was last revised.

Continued use of SX Consent after an updated Policy becomes effective means you accept the updated Policy where permitted by law.

If you do not agree to an updated Policy, you must stop using SX Consent and cancel your subscription before the next renewal according to the purchase channel’s rules.

  1. Survival

This Policy survives subscription cancellation, account cancellation, account deletion, data deletion request, suspension, termination, refund request, chargeback, payment dispute, app deletion, app uninstall, plan expiration, discontinuation of service, and the end of your relationship with SX Consent.

Payment obligations, no-refund provisions, chargeback provisions, fraud-prevention provisions, records-retention provisions, indemnification rights, dispute-resolution provisions, provider-compliance provisions, and any provision that by its nature should survive will continue to apply.
